President’s Message - By Max Perry

Greeting everyone. Your Board has been very busy this month.

I want to begin by expressing our great appreciation to Scottie Blum and Robert Frost for their service to Esperanza Estates and the Board. Both resigned this month after many years of dedicated service. They will be greatly missed. Also a big thank you to Phyllis Johnson Frost for her service to the Hospitality Committee. Phyllis left that position this month as well.

Robert and Scottie's departures create two vacancies on the Board. I want to encourage any homeowner interested in completing these terms (both end December 31, 2005) to simply call me at 331-2973 or drop me a note at mbperry@cox.net I'll be happy to discuss these positions or answer any questions I can. It's a great opportunity to help your Association. The Board will fill these vacancies at the April 18th meeting, so please let me know by the 15th.

I want to remind everyone that you have only a few more days to get your tickets for the Home Tour, Sunday, April 3. See Joan Moreaux's article below for details. It'll be a great day and I know we're all interested in seeing the unique ways our neighbors have decorated their homes.

Finally, the Board unanimously approved the resolution that appeared in last month's Periodico. Your Board has no intention of unnecessarily imposing itself on neighbor to neighbor issues. We want to encourage everyone to work with their neighbors to resolve any disagreements over plant life. We're all working for the betterment of our neighborhood.

That said, 80% of those responding to the advisory vote saw a need for the Board's periodic involvement and your Board has responded. Let's hope that involvement will be rarely needed. Tom Cooke has done a terrific job dealing with this issue and I thank him for his efforts.

Esperanza Estates Home Tour - - - Joan Moreaux, Chair

Mark your calendars for Sunday, April 3nd from 1-4 PM for the Esperanza Estates Home Tour.

Eight homes will be on the tour. There are various models ranging from original design to modified structures and unique decorating ideas. This is a wonderful opportunity to see unique homes and meet your neighbors .

The tour is open to all Esperanza Estates residents and their guests. Tickets are $10.00. You need to purchase your tickets now, as they are limited to 150 and going very fast and may not be available the day of the tour. If you and your friends wish to tour together, tickets must be purchased together. We were sold out at the last tour. There will be a wine and cheese party at the conclusion of the tour.

We have a Good Samaritan in Esperanza Estates who will collect all of your waste products and transport them for you...call Hal McMickle, 690 Placita Nueva, 393-1390.

A List of Acceptable Waste Products: Automotive fluids, Batteries (Alkaline batteries must be discarded in trash), Drain cleaners, Fire extinguishers, Fluorescent light bulbs, Herbicides, Hobby chemicals, Household cleaners, Ink and toner cartridges, Lawn and garden products, Medications (no sharps), Paint products, Pesticides, Polishes, Pool chemicals, Propane tanks for BBQ grills, Solvents. Also items labeled: "acid," "caustic," "flammable," "poison," "toxic," or if the label contains the words "caution," "danger," or "warning."

This is a good time to get rid of expired medications. Clean out your garage and closets before you leave for the summer.

A Special Day of Health and Fun – Friday, April 8, 2005

Carondelet St. Mary's Hospital is opening a new 30,000 square-foot Emergency Center and we designed it with you in mind. We can't wait for you to see it at a special Green Valley preview Friday, April 8, and we'll even provide the transportation!

Buses will pick you up in Green Valley at the Carondelet Medical Group office at 1141 S. La Canada every hour on the hour from 8 a.m. to 2 p.m. and take you to St. Mary's. You can catch a shuttle bus from St. Mary's to the Casino and then back to St. Mary's or home to Green Valley. The last bus will head back to Green Valley by 2:30 p.m. from St. Mary's.

Announcement—By the Board

The Board advises an address and phone number was inadvertently left out of the new EE Directory. The name that should have been included but was overlooked is: Alford & Carolyn Ackerman, 1093 Circuio del Sur, telephone 625-0302. Please write this into the correct place in your copy of the Directory. The compilers regret the omission, and thank you for your cooperation.

Common Area Maintenance – By Tom Cooke, Chair

Common Area Report for March
Sightings of snakes are being reported within the subdivision, so apparently the snake season is now here. The snake removal phone number is 629-9200. A call to this number will produce an amazing fast response by the local fire department, who will remove and relocate the snake at no cost to you. The snakes are not harmed, but taken to a desert area and released.

The fire areas at the EE Park have been altered to enhance their functionality. Two of the small pits have been eliminated, and a large fire ring constructed n the center of the Park. The smaller pits were basically useless, and the change will make it possible to have a bon fire safely for evening functions that take place there.

Weed spraying is continuing, and will be until all areas have been treated. If you think your area may have been missed, please give me a call. Owners are once again reminded that it is your responsibility to treat the weeds in your front yard in a timely manner. Please check your yard and take of this if you have not done so.

A previously overlooked section of common wall has been repaired and painted. We missed this the first time, as it was behind a quad unit and was unknown to members of the committee who were working on this project. We now think we have completed the repainting of all of our walls.

The Board has authorized additional funding for the re-graveling program, in an effort to attempt substantial completion of all common areas requiring attention. It had been contemplated to finish this work over a period of years, but after further analysis this approach did not appear to be making sense any longer, and has been altered. Work will begin over the next few weeks. Comments received by the Board suggest this program has been widely appreciated within the subdivision.

All other matters involving the common areas appear to be stable at this time, but as always, please call me at 399-0455 if you have or observe any problems.

Passage of Resolution——— By the Board

At the Board meeting on March 21st, the Board unanimously voted to enact the following Resolution, following discussion and comment by interested attendees. It will become effective by its terms following publication in this issue of the Periodico.

RESOLUTION

Whereas, pursuant to Article XII, Sections 12.2,12.3 & 12.6, and Article XIII, Section 13.3.1 of the Amended Restatement of Covenants, Conditions & Restrictions of Green Valley Esperanza Estates dated April 26th, 2001 each owner of a property within the subdivision is obligated to maintain all trees, shrubs, and landscaping situated upon said property, and

Whereas, pursuant to the same Articles and Sections it is the duty of the Board of Directors to enforce said requirements, and

Whereas, said Board has authority pursuant to Article VII, Section 7.1.3 of the Amended & Restated Bylaws to promulgate rules and regulations relative to said enforcement, and

Whereas, at an advisory vote of the membership of the Association during the Annual Meeting held in January, 2005, over 80% of the members voted to request the Board to adopt such rules and regulations,

Now, Therefore, it is RESOLVED:

1. It shall be the duty of all owners of property within Esperanza Estates to maintain all trees, shrubs, and other landscaping, in such a manner and with such frequency as will keep each said owners lot in an attractive, well-kept, condition.

2. The foregoing shall apply to all such flora within each owners patio walls, and that area forming the front yard. The term "front yard" shall be that area between lines extended from the center of each boundary wall to the edge of the street adjoining the property to the front. This definition shall have no applicability to Quad yards.

3. All trees and other flora shall be maintained in such a manner they do not drop in excess of negligible amounts of leaves, needles, seeds, nuts, fruit, bark, berries, buds, petals, flowers, branches, sap, or other debris upon any adjoining property, including the roof of any adjoining property. The term "negligible amount" shall be defined as that amount of such debris that would be acceptable to a reasonable person.

4. No owner may maintain any tree or other flora with a root system which causes damage to a party wall or an adjoining patio. Any such damage that may be discovered shall be the responsibility of the owner of the property where the offending flora is growing, and the Board shall have the authority to order the removal of the same in the event the damage shall be continuing.

5. Nothing contained herein shall prevent two or more owners from entering into a private agreement respecting any tree or other flora, allowing any arrangement acceptable to the parties.

6. Owners are encouraged to attempt a resolution of any problem of a type herein enumerated directly with the alleged offending party. If not successful, a complaint alleging a violation of any provision herein contained shall be in writing and presented to the Board of Directors, and shall be signed. Upon receipt of such a complaint, the Board shall investigate and proceed with the procedures as provided in Article XIII, Section 13.4.1 et seq. of the CC&R's as referenced above.

7. This Resolution shall be in full force and effect upon its passage and publication in one issue of the Periodico.

Neighborhood Watch Report – By Melodye Cooke, Chair

The meeting of the Neighborhood Watch sponsored by the Sheriffs Auxiliary Volunteers was held March 1 with Esperanza Estates resident Judge Charles Shipman being the guest speaker.

Judge Shipman stressed the importance of visual signs stating that our subdivision was a part of the Neighborhood Watch program. This has been shown to have a significant effect in reducing crime. It was also stressed that garage doors should be kept closed as much as possible. We are fortunate that Green Valley has a low crime rate, but awareness needs to continued.

Max Perry and I have discussed the need for Neighborhood Watch volunteers to have a protocol in the event special assistance is required by our residents. A special meeting is needed to discuss and adopt such a protocol, and to make available information about other groups in Green Valley who are able to offer such assistance. Please contact me if you would like to participate in setting such guidelines, at 399-0455.

We have posted signs in our subdivision stating that soliciting is not allowed, but occasionally we have people come into Esperanza Estates in violation thereof. If you observe such a problem, please call 911, or Max Perry, for assistance.

We all need to be alert about what is going on in our subdivision, and to be vigilant about matters out of the ordinary.

Our fund raising activities for this season have come to an end as we approach the summer months when many of our residents head for cooler spots.

We are now focusing on upcoming events for the Fall - Winter season, and plan to hold our annual garage sale early in the New Year. At this time we are requesting donations of household items, clean and gently used in good condition. (No Clothing Please) for this upcoming event. This is an excellent way for residents to recycle or purchase things for their homes. As always all proceeds go toward the enhancement of our community.

Just a reminder that the Ramada outside the Pool Area is available for your private parties. There is a sign-up calendar on the Pool Area Bulletin Board. Please leave a contact number when you sign up for a date.

We encourage all of our members to utilize this area and see what has been accomplished over these past few years with Volunteer efforts and direct donations from members. Counter & Storage Cabinets; Brick work; Sunset Park including plants, planters, sprinklers and fountains.

Neighborhood Relations – By Norma Stanley, Chair

Three items, all involving illegal parking of pickups and a van , were addressed. One was an ongoing problem and a second letter was sent to that homeowner. The other two homeowners were contacted by phone and both have agreed to comply with the CC&Rs regarding this matter.

Now that we have a new resolution regarding overgrown trees adopted by the Board, the next MOST pressing Neighborhood Relations problem is the overnight parking of unauthorized vehicles, namely camper-vans and trucks.

Hospitality - By Norma Stanley

The Hospitality Committee is now under the auspices of Pro-Tem Chair, Norma Stanley. The Committee will meet the second week of April to discuss plans for the Cinco de Mayo party. Another four to six prospective members will be invited to attend. We hope to have another WOW! Hospitality party!
