President's Report--Max Perry, President

By all accounts this has been a banner year in Esperanza Estates. Your Board has accomplished more this year than any Board in recent memory due to a strong sense of cooperation and teamwork. Let me tick off some of the accomplishments.

In the pool area we saw the bathrooms completely remodeled, and the storage building enlarged to accommodate needed space for the Hospitality committee. We have signed a contract for the repair of the spa with the hope that it will finally do the job we all want…..powerful jets. The new ramada project is in the architect’s hands, and we hope to get started on that in February. The impact of this project on our neighborhood will be amazing. Weather, both heat and cold, will be far less a factor when planning events. Our hope is the new ramada will become the focal point for many gatherings in Esperanza Estates. In addition, at the tennis courts we rebuilt the back wall of the shelter before termites ate the whole thing.

In the common areas we applied over $11,000 in gravel, especially in the alleys. We have been doing this in small doses for several years, and it was felt why not finish the job for the foreseeable future. We also expanded the bricked area at the ramada—size was doubled—creating more space for gatherings, completed another section of the Trail where it passes through Whigham Wash and reconfigured the fire pits in Flag Park to make them more useful and user friendly.

Under the heading of Association administration, there have been a number of improvements as well. The Hospitality Committee requested that the Board allow them to become independent financially from the Board, much as the Volunteers (now Esperanza Enhancement) Committee has been for several years. This was granted and the results have been spectacular. The number and quality of the social gatherings have increased greatly and the attendance has shot through the roof. A much greater feeling of community is obvious thanks to their efforts. A new project near and dear to my heart, especially on Sunday night, is the introduction of the Monday Morning Memo. Now reaching over 85 homes, this weekly newsletter has become, from what I hear, a much anticipated communication tool. The idea originated with Board member Bruce Liljegren, and I will be forever grateful.

And finally, speaking of Bruce, he has decided not to run for a full term on the Board this year. Bruce has been a tremendous asset to the Association this year in many ways. His greatest chore, or burden, has been to manage our pool. This he has accomplished superbly. He will be greatly missed. Thanks Bruce.

So, I think, it is obvious this has been an historic year in Esperanza Estates. All that remains is our Annual Meeting to be held on Monday, January 16, 2006, at Desert Hills Recreation Center at 1:00 pm. Next week you will be receiving the official notice plus ballots for the Board election and the proposed changes to the parking regulations in the CC &R’s. Please, please, please take the time to examine both the candidates and the parking language and let your voice be heard by voting. It’s your Association! See you at the Annual Meeting. Esperanza Enhancement Committee (formerly “The Volunteers”)

At our first meeting of the season the decision was made to change our title to something that better defines the aims of our committee. Our goal has always been to improve and beautify the common areas of Esperanza Estates and hopefully our new name describes those interests. To fund these enhancement projects we run garage sales, auctions and raffles. We also received generous donations from the Home Tour Committee and from individual donors.

Golfers—Don’t forget the 9-Hole Scramble being organized by our own resident golf pro- Marvol Barnard for March 1 at Haven Golf Course. Marvol says this will be a FUN game for Esperanza golfers and friends—followed by a wine and cheese party. Proceeds will go to our latest project- the addition of “ESPERANZA ESTATES” to the bell arch on the Portillo side of Sunset Park.

Hospitality- by Sam Barnard, Co-Chairman
This month’s Hamburger Night (we called it Santa Burger night) on Dec. 13 was another great success. We served 100 Hamburgers and 17 Veggie Burgers to our hungry neighbors. We also had complimentary cookies, eggnog and apple cider.

All of the members of your Hospitality Committee who volunteer to do this work really appreciate your attendance and participation as it makes the work worthwhile when we see our friends and neighbors having a good time. We also would like to hear from you as to what type of meals or gatherings you would like to see held here in Esperanza Estates and we are always looking for new volunteers who can bring fresh ideas and energy into the Committee.

We want to especially thank new residents Charles and Dana Parsons for their generosity in donating the refrigerator that is now at the pool. This makes our job much easier.

For the upcoming month of January, your committee has not been idle. We have been agonizing over what to surprise you with next and after much thought we have come up with the idea of a homemade Chili night on Tuesday January 10. We thought that a bowl of hot, homemade Chili would help ward off the winter chill.

Recreational Facilities - By Bruce Liljegren, Chair
I am happy to report that the pool cover is working again and heaters for both pool and spa have been repaired. The pool is at a comfortable 87 degrees and the spa is in the range of 101 to 102 degrees.

Gary Chelseth reports that additional work on the spa will begin in late January. As I go off the Board this month I want to take this last opportunity to wish everyone a Merry Christmas and a Happy New Year.

Common Areas - By Tom Cooke, Chair
All matter within the common areas are under control. Maintenance requests are being met in due course, and no problems of consequence have been noted.

The landscapers are working on the larger areas at present, and working their way from west to east. They should start on the areas east of Portillo shortly, and will finish those areas over the next few weeks.

Our weeds are being taken care of routinely, and only a few areas remain for treatment. Some limited gravel work will be commenced in January, primarily in a few of the quad yards. More work in the Bridge Park wash is planned, but has been delayed due to the difficulty of scheduling a firm with the right type of equipment. As soon as we can get this finally scheduled for completion, this phase of the project will be finished. Further work in the wash will be accomplished over the coming months. The overall end goal is to minimize the amount of sand which washes down onto the roadways during the monsoon periods.

New Parking proposal—by the ad hoc committee

For the past couple of years, the Board has received regular complaints about the parking regulations contained in the CC&R’s. Accordingly, following a written survey showing a substantial number of homeowners felt changes were warranted, an ad hoc committee was formed to study and take input on this. Two meetings were held, at which approximately 25 homeowners participated in discussions about modifying the regulations to bring them up to date, clarify some problem areas, and render them more suitable for the subdivision. The following is the work product of that committee, organized into final format by the Board’s legal counsel.

These modifications will be put to the homeowners at the annual meeting in January, for a vote. Fifty-one percent of our owners must approve these changes before they can take effect. They are being published here for the second time to give our owners the time to read and consider them carefully. Please feel free to discuss these proposed changes with your neighbors. The following is the final form of the changes that will be put forth for approval. The Board has endorsed this purposed language.

AMENDMENT TO AMENDED AND RESTATED DECLARATION FOR ESPERANZA ESTATES HOMEOWNERS ASSOCIATION

This Amendment to the Amended and Restated Declaration of Covenants, Conditions and Restrictions which were recorded on May 11, 2001 at Docket 11547 at Page 1857, was adopted on the of , 20 , by the affirmative vote of at least 51% of the members of ESPERANZA ESTATES HOMEOWNERS ASSOCIATION, INC., [“Association”] an Arizona Nonprofit Corporation, in the manner set forth in Section 14.2 of such Declaration.

NOW, THEREFORE, the undersigned being the President and Secretary of the Association, certify that at least 51% of the Members of the Association have affirmatively voted in favor of adopting this Amendment to the Amended and Restated Declaration of Covenants, Conditions and Restrictions.
Section 9.2 is deleted in its entirety and the following new Section 9.2 is substituted in its place.
9.2 Parking:
9.2.1 Statement of Policy: To promote uniformity within Esperanza Estates and to ensure the attractive appearance of the subdivision, it is the policy in Esperanza Estates that all vehicles must be kept in the garage whenever possible.
9.2.2. Restrictions on certain vehicles: No Owner can park or permit to be parked in any driveway, or on any street, or in any patio or front or rear yard of any lot, or on any common area, any of the following types of vehicles:
1. any vehicle containing living or sleeping, and/ or toilet areas; 2. boat trailer, luggage trailer, travel trailer, house trailer, mobile home or similar vehicle except for brief stops necessary for loading and unloading or preparing for a trip. Such vehicles may be parked in the garage or carport. The term “brief stops” means parked outside of the garage or carport for not more than 48 continuous hours. This period cannot be extended by moving the vehicle and returning it to circumvent the parking restriction. No more than four (4) Brief Stops of these vehicles in any calendar quarter are permitted up to a maximum of eight (8) Brief Stops in any calendar year. 3. No vehicle with advertising or commercial lettering is allowed to park in any driveway, or on any street, unless parked temporarily while actually doing business with or providing services to an owner. 4. Any vehicle type which fits inside of the garage and will be regularly garaged, is authorized.
5. Any unregistered vehicle, or vehicle without current license plates is prohibited except in the enclosed garage. 6. Any pick-up which will be parked in the garage is allowed. Pick-up trucks are authorized to be parked in the driveway, unless: a. the pick-up truck has more than four wheels; b. the pick-up truck has advertising or commercial lettering on it; c. the pick-up truck has a visible load in the bed, except during the time that of actual loading or unloading. d. These prohibitions do not apply to yard workers or service personnel engaged in actual work at a Lot. 7. Parking in Quad Driveways. With regard to Lots with quad driveways, those driveways are located in the Common Areas. The Owners of such Lots may temporarily park authorized vehicles in the respective driveways, provided they park as close as possible to their garages and provided further that they do not block any other owner from reaching another garage. All other parking restrictions set forth in this section including recreational and other vehicle parking apply to the quad driveways. The right to park in the quad driveways located in the common areas does not negate the other restrictions set forth in this Declaration regarding the use and occupancy of the common areas.
8. Blocking of Sidewalks. No vehicle may be parked in the subdivision in a manner that blocks or signiW?cantly impairs pedestrian travel on any sidewalk.
9. Storage of Vehicles in Driveways Prohibited. No vehicle may be stored on the Lot or left in the driveway in a condition where the immediate use of the vehicle is not possible, such as on blocks, or covered with a tarp.
10. Exemption for Emergency Vehicles. No restriction affects any emergency vehicle actively engaged within the subdivision. 11. Visitors & Guests. The Board of Directors may adopt rules regarding the issuance of permits to allow temporary, short-term parking of authorized vehicles by visitors and guests within the subdivision. Effective date: These amendments to the Declaration become effective upon the recordation of this amendment in the OfW?ce of the Pima County Recorder in accordance with Article 14.2 of the Declaration. Dog Litter - By Sheila Bennen

There is an increase in the number of people that are not picking up their dog’s litter. It appears to be predominately on Esperanza Blvd. but other areas have been reported. Please observe these violations and kindly remind the offenders that there is a Pima Co. regulation against these actions. The Pima Co. regulation is 6.04.030. It states:
Dog Waste Removal Required.

Section E. It shall be unlawfil for the owner or person having custody of any dog to fail immediately to remove and dispose of in a sanitary manner any solid waste deposited by such dog on public property or deposited on private property without the consent or the person in charge of the property. Penalties. A person convicted of the offense prohibited by subsection (E) of this section is guilty of a Class 3 misdemeanor, which is punishable by a fine of not less than one hundred dollars nor more than five hundred dollars, 30 days in jail, one year probation, or any combination thereof. No judge may grant probation in lieu of, or otherwise suspend, the imposition of the minimum fine prescribed herein. You must remember, however, if you are really annoyed and know the offender or we can identify them we must first document the offense while it is happening. A VERY DIFFICULT TASK!
